1. Agreement to Terms
By accessing or using CareFlow ("Service"), a calendar application operated by the CareFlow project (the "Operator"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
2. Eligibility
You must be at least 13 years of age to use this Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. By using this Service, you represent and warrant that you:
- Are at least 13 years old
- Have the legal capacity to enter into a binding agreement, or have consent from a parent or legal guardian
- Are not prohibited from using the Service under any applicable laws
- Will provide accurate, current, and complete information
3. Service Description
CareFlow is a calendar application that helps you organize events, appointments, and reminders. The Service allows you to store calendar data locally on your device and optionally sync it to the cloud for backup and access across multiple devices.
4. Account Registration and Security
4.1 Account Creation
To access certain features, you must create an account using Firebase Authentication. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4.2 Device Registry
Our Service implements device tracking for security purposes. Each device is assigned a unique identifier and registered in our system. You acknowledge that:
- Device access may be revoked at any time
- Device fingerprinting is used for security and fraud prevention
- Multiple devices may be registered to a single account
5. Subscription and Payment
5.1 Lifetime Membership
CareFlow offers a lifetime membership option processed through Stripe. By purchasing:
- You agree to pay the one-time fee as displayed
- We do not issue direct refunds. Refunds, where applicable, are handled exclusively through Stripe's dispute/chargeback process
- Membership benefits are non-transferable
- Access may be terminated for Terms violations
5.2 Payment Processing
- Payments are processed securely through Stripe, Inc.
- You authorize us to charge your payment method
- You are responsible for any applicable taxes
5.3 Refunds and Disputes
- The Service is provided as-is; we generally do not offer direct refunds
- Eligibility: we will consider refund requests for charges within the last 60 days, typically where the charge is deemed out of scope (e.g., duplicate charges, unauthorized or erroneous billing)
- Subscriptions: most refund considerations relate to subscription charges from the last 60 days
- Process: initiate a dispute/chargeback via your payment method; Stripe and your card network will adjudicate the claim
- We may submit evidence to Stripe and may contest disputes we believe are unfounded
- Any refund granted will be processed by Stripe; timing and outcomes are determined by Stripe and card network rules
6. Acceptable Use Policy
You agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or interfere with the Service
- Attempt unauthorized access to any portion of the Service
- Harass, abuse, or harm other users
- Misrepresent your identity or affiliation
- Use the Service for any illegal or unauthorized purpose
- Store or transmit illegal, harmful, or inappropriate content
7. Privacy and Data Protection
Your use of our Service is also governed by our Privacy Policy. By using CareFlow, you consent to:
- Collection and processing of personal data and calendar data you provide
- Storage of data in accordance with applicable laws
- Cross-border data transfers as necessary for Service provision
Hosting regions: Firebase us-central1 (USA) and australia-southwest1 (Australia). Data may be processed in either region as part of providing the Service.
8. Intellectual Property Rights
8.1 Our Rights
The Service and its original content, features, and functionality are owned by the CareFlow project (the "Operator") and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Your Rights
You retain ownership of any content you submit, but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content as necessary to provide the Service.
10. Disclaimers and Limitation of Liability
10.1 Service Availability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any loss of data, profits, or business opportunities
10.3 Non-Excludable Rights
Nothing in these Terms excludes, restricts, or modifies any consumer rights that cannot be excluded under applicable law. For Australian users, this includes rights under the Australian Consumer Law.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and its contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or transmit through the Service
12. Termination
12.1 Termination by You
You may terminate your account at any time by using the "Delete Account" feature under your profile settings. Upon account deletion:
- Your account will be immediately deactivated
- All associated data will be permanently purged from our systems within 30 days
- This action is irreversible and cannot be undone
- Any active subscriptions or memberships will be cancelled
12.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Prolonged inactivity
12.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- We may delete your data subject to our data retention policies
- Provisions that by their nature should survive termination shall survive
13. Dispute Resolution
We believe in resolving any disputes through open communication and mutual understanding. If you have any concerns or disputes regarding these Terms or the Service:
- Direct Communication: Please contact us first through the available support channels to discuss your concerns
- Good Faith Negotiation: We commit to engaging in good faith discussions to reach a mutually acceptable resolution
- Flexible Resolution: We are open to various forms of resolution including mediation, arbitration, or other mutually agreed methods
- Legal Rights Preserved: Nothing in this section prevents either party from pursuing legal remedies if good faith negotiation fails
Governing Law: These Terms shall be interpreted according to the laws applicable in your jurisdiction, while respecting the international nature of the Service and the principles of fair dealing.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by:
- Posting the new Terms on this page
- Updating the "Last Updated" date
- Sending notice through the Service or via email
Your continued use after changes constitutes acceptance of the modified Terms.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and the CareFlow project regarding the Service.
17. Contact Information
The Operator does not provide a public support email or physical address and does not intend to in the future. All communications must be submitted via the in-app contact form. No alternative support channels are offered.
By using CareFlow, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
